All the materials on Rando Creator are provided "as is". Rando Creator makes no warranties, may it be expressed or implied, therefore negates all other warranties. Furthermore, Rando Creator does not make any representations concerning the accuracy or reliability of the use of the materials on its Application/Website or otherwise relating to such materials or any sites linked to this Website.

3. Limitations of Liability

To the maximum extent permitted by applicable law, in no event shall Rando Creator its officers, directors, employees or affiliates, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Rando Creator assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

4. User Account

(a)In order to access Rando Creator’s products, you must first register and create an account via our application/website.
(b)You must provide accurate information when registering your account and must ensure that you are the exclusive owner of the email you use to sign up.
(c)In case of an ownership dispute, we reserve the right to perform an independent investigation to resolve the dispute.

5. Obligations

(a) In order to use Rando Creator you have to be at least 18 years old.
(b) You confirm that you own all rights for the content that you upload to Rando Creator including any designs, images, audio files, fonts, logos, code, illustrations, compositions, artworks, interfaces, usernames, the information you provide for the purpose of creating a subdomain name, text, literary works and any other content, or otherwise have (and will continue to have) the full power, title, licenses, consents and authority, in and to the User Content, as necessary to legally access to, import, copy, use, publish, transfer or license such User Content, by you and us or any of our affiliates;
(c ) You ensure that your uploaded content is and will be true and accurate and that you have obtained all permissions and consents required by all applicable laws to use the content that you upload.
(d ) You are solely responsible and liable for any damages that might occur by you using Rando Creator’s services and/or by uploading content to Rando Creator.
(e) You will NOT copy, modify, decompile, disassemble or reverse engineer any of Rando Creator’s services and/or technology.
(f) You will NOT act in any manner which might be damaging to the Rando Creator platform or its reputation.
(g) You will NOT use Rando Creator to display content that may be deemed as fraudulent, illegal or insulting.
(h) You shall NOT impersonate any other person or provide any false or misleading information.

6. Loss of Data

(a) If your user account is cancelled/deleted all of your personal data and websites will be irreversibly deleted. Rando Creator shall not be liable in any way for the loss of this data. It is your sole responsibility for backing up your data regularly.

7. Third Party Services

Rando Creator enables the user to use third party services, products, tools and applications for enhancing the user experience. You acknowledge and agree that these services are not directly offered by Rando Creator and that Rando Creator only acts as an intermediary platform between you and such Third Parties. Any Use of such Third Party Services shall be done at your own risk and may be subject to further legal requirements as specified in the terms of service of these Third Parties.

8. Site Terms of Use Modifications

Rando Creator may revise these Terms of Use for its Application/Website at any time without prior notice. By using this Application/Website, you are agreeing to be bound by the current version of these Terms and Conditions of Use.

9. Application and Acceptance

Once you complete an application to become a Rando Creator, we will review your application and notify you if you have been accepted to participate in the Rando Creator Program, or not. If we do not notify you that you are accepted to participate in the Rando Creator Program within thirty (30) days from your application, your application is considered to be rejected.
If you are accepted to participate in the Rando Creator Program, then upon notification of acceptance the terms and conditions of this Agreement shall apply in full force and effect, until terminated pursuant to the terms set forth below.
You will comply with the terms and conditions of the Rando Creator Program and this Agreement at all times, including any applicable Program Policies.

10. No Additional Benefits

Other than the Rando Creator Program Benefits described on the Rando Creator Application/Website, no fees, commissions or other payments will be due or payable to you under this Agreement. All payments will be made in Indian Rupees (INR).
Each party is responsible for its own costs and expenses related to this Agreement and their respective products and services. We may make available to you, without charge, various production, editing, marketing, and promotional support and other resources as part of our Rando Creator Program. If we make such resources available to you, you are not required to use them; however, we encourage you to participate and use such resources as you see fit. All Rando Creator Program Benefits (including marketing and operational investments) are to be used solely in connection with Your Show; you may not use them for yourself or in connection with a show other than the one(s) approved by Rando creator.
Your podcast will get an initial Baseline payment ranging from 5 INR to 500 INR, based on the quality of the content, audio, and audience reach.
After your podcast has received 1000 total listens, the TEAMUP button will be unlocked. The initial pay for the podcast will be retained for 150days from the day you start your podcast in Rando Community, which will be released along with your current profits after 150 days. Physical Awards will be delivered to your address whenever you get a particular number of listens for your podcast.

Copyright Infringement Notification (DMCA Notice)

If you believe that your copyright-protected work was posted on RadioRando’s site or app, or otherwise hosted by RadioRando, without authorization, you may submit a copyright infringement notification to our grievance officer Mr. Dhanavikram The notification must include the following:
• An email address, physical address or phone number so that we and the uploader of your work can contact you.
• A clear and complete description of your work that you believe has been infringed
• The URL or other identifying location of the allegedly infringing work.
• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law.
• A statement, made under penalty of perjury, that the above information is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner.
• The physical or electronic signature of the copyright owner or an authorized representative of the copyright owner. To satisfy this requirement, you may type your full legal name (not that of a company) at the bottom of your notification

11. Your Duties and Restrictions

During the term of this Agreement, you agree that you will (a) abide by all requirements of this Agreement including the Program Policies (including but not limited to our Rando Creator Media Network Usage Guidelines), (b) continue to meet all criteria applicable to your Rando Creator Program tier, (c) comply with all applicable laws and regulations, and (d) respect the intellectual property, privacy, and other rights of third parties
